Malta Residential Property Buying Procedure
To obtain an indication of the types of properties available for sale, we suggest that you browse through the selection of properties listed on our website. This list is not exhaustive and we strongly suggest that you get in touch with us for further lists and assistance.

The signing of the final deed is, however, always subject to clear title and the issue of any relative permits to purchase, if necessary. The agreements and contracts are written in English. On signing the preliminary agreement, a sum equivalent to 10% of the price is lodged with the agent or notary public as stake-holder. This deposit will be forfeited in favour of the vendor should the purchaser fail to complete the final deed of transfer for no valid reason at law.

The agreement is usually valid for three months (term prescribed by law) or as mutually agreed by the parties. During the period between the signing of the preliminary agreement and the signing of the final deed of sale, a Notary Public engaged by the purchaser will carry out the necessary researches into the property to confirm good title, as well as submit the application for a permit to purchase, to the Ministry of Finance if such permit is necessary.

Once the relative permit has been issued and researches have proved clear title to the property, the final contract of sale may be entered into – the deed of sale being drawn by purchaser’s Notary. The balance of the purchase price and Stamp Duty plus legal expenses are paid on the signing of the contract when vacant possession to the property is handed to the purchaser.

EXPENSES
Expenses related to the acquisition of property include:
• 5% stamp duty
• 1% notarial fee (apprx.)
• €600 title searches and title registration fees (apprx.)
• €233 AIP permit fee (where applicable).

These costs are the liability of the purchaser, whilst agency fees are borne by the vendor.

CONDITIONS FOR BUYING PROPERTY
Non-residents may freely purchase property in Malta, subject to obtaining an AIP permit, if such permit is necessary.

An AIP permit will not be required to purchase properties in Special Designated Areas and, in the case of EU citizens who :

• Have been resident in Malta for at least five continuous years;
• Intend to purchase a property which is to serve as their primary residence; or
• Who intend to purchase a property for investment purposes.
• Where one of the spouses is an EU citizen and the other spouse is a non-EU citizen, both can likewise benefit from the exemption outlined above and acquire property without the necessity of obtaining an AIP permit, provided the acquisition is being made to establish therein their primary residence.

Also exempted is the acquisition of immovable property by an EU national for the conduct of one’s business activity or for the supply of services by such person. In such a case, a declaration reflecting the purchaser’s intention for the acquisition should be inserted in the relative contract of purchase.

Where the purchase requires an AIP permit, the property must satisfy a certain minimum value which changes periodically and which currently stands as follows: € 136,972 for apartments and maisonettes and €236,582 for villas, townhouses and other property. These values are index linked and thus may be subject to revision annually.

The property purchased has to be used solely as a residence by the applicant and his family. This condition will be waived once the applicant obtains the relative permit to rent the property.

The above-mentioned individuals may only own one property in Malta and Gozo (except in special designated areas where one may purchase more than one property). Once these applicants have purchased a property in Malta and wish to acquire another one after having sold the first one, they may do so after obtaining permission from the Ministry of Finance. Applications for permission to acquire another property are normally favourably considered. Permission will be granted subject to the first property being sold.

Citizens of all European Union member states, who have resided in Malta continuously for a minimum period of five years at any time preceding the date of acquisition, may freely acquire more than one immovable property without the necessity of obtaining a permit.

EU citizens, who have NOT resided in Malta for at least five years, but have the intention of purchasing their primary residence i.e. take up residence in Malta, do not require a permit. Nor do they require such a permit to purchase immovable property required for their business activities or supply of services.

• Individuals who are NOT citizens of a European Member State may acquire immovable property after they obtain the relative permit (AIP permit) in terms of Chapter 246 of the Laws of Malta from the Ministry of Finance, unless they acquire property located in a Special Designated Area.

• When purchasing a property in a Special Designation Area, no restrictions whatsoever apply. Foreigners (EU and non-EU) may purchase any number of units within such developments without the need for an AIP permit, hence such purchases are not governed by any of the above mentioned conditions.

ACQUISITION OF PROPERTY BY A GROUP OF PERSONS
A body of persons, other than a commercial partnership, established in and operating from a European Union member state may freely acquire immovable property that is required for the purpose for which it has been set up as long as it is directly controlled by citizens of a European Union member state who have resided in Malta continuously for five years.

A commercial partnership established in and operating from a European Union member state (therefore including Malta) may freely acquire immovable property that is required for the purpose for which it has been set up as long as such partnership is controlled by and at least 75% of its share capital is held by a person (or persons) who is a European Union member state citizen and who has resided in Malta continuously for five years.

Any other body of persons will require a permit, which is only granted if the property is required for an industrial or touristic project or as a contributor to the development of the economy of Malta. Permission may be refused for the purchasing of a property, which is considered to be of historical interest.

Mortgage facilities are available for the purchase of property from all banks in Malta, subject to residency/citizenship status and the availability of collateral. (Refer to Obtaining bank loans in Malta).

Malta Residential Property Rental Procedure
Renting property in Malta is extremely simple. Foreigners coming to Malta, be it on a work appointment, to retire or to take up residency on the island, can rent a property with no restrictions.

Rental rates are extremely reasonable and vary depending on location, type of property, standard of furnishings and duration of tenancy. It is often the case that properties are rented furnished including fittings & appliances, however, we do have a good selection of properties that are available unfurnished. Rates for water, electricity, internet and TV are not normally included in the rental rate if it is a long-term (normally defined as four months and over). These expenses are borne by the lessee on a consumption basis.

Malta and Gozo offer a great selection of properties to let located across the islands, suiting all budgets, tastes and lifestyle requirements. The Inner Harbour region, including St Julian’s, Sliema and Msida are most popular for those looking at working in Malta. Those who prefer to stay away from the hectic city life will find inland, western and southern Malta more appropriate, such areas offering a more relaxed lifestyle and a more authentic feel of the island. Gozo also offers its share of properties, particularly popular for holiday breaks and as a retirement destination.

All towns in Malta are well equipped with all necessities for day-to-day living offering a good selection of shopping centres, department stores, health centres and clinics, entertainment hubs and so on. The islands also boast of a dynamic night life and ample beaches. In terms of properties, these range from standard apartments to town houses and houses of character; from seafront developments to villas and bungalows with large gardens and pools. There are no particular expenses relating to the letting of property, except for estate agents’ fees which normally amount to half a month’s rent, plus VAT. It is common practice to lodge a sum equivalent to one month’s rent with the lessor as a deposit against breakages and outstanding bills. The deposit is refunded to the lessee upon the termination date of the lease, or is offset against any pending bills or damages to the inventory as agreed between the parties.

Rental rates vary depending on location, type of property, standard of furnishings and length of tenancy. In most cases properties are rented furnished, however, we do have a good selection of unfurnished properties. In the case of long lets, water, electricity and TV rentals are the liability of the tenant and are charged separately.

Rent is normally paid monthly in advance. Estate Agency fee is equivalent to one month’s rent (plus VAT), which is shared equally between landlord and tenant. A refundable deposit also equivalent to one month’s rent is normally lodged with the landlord to cover breakages and outstanding bills at the end of the lease.

Malta Property Investments
International financial markets are unstable, and major economies – be it Western Europe, the United States or China - have stagnated or at best slowed down. It is safe to presume that the coming years are not offering too many bright options for investors, or at least not for the immediate future. This is exactly where the merits of investing in property come in.

Mortar and bricks have always been considered a solid investment in Malta.

The influx of foreign nationals moving to Malta, be it to retire, to relocate or to work here, has paved the way for a new golden opportunity – rental investment. The growth of niche industries such as gaming, pharmaceuticals, back-end office operations and financial services has led to a strong surge in demand for rental properties.

What’s more, interest in Malta as an ideal destination where to retire or relocate to is on the rise, with many opting to rent, and eventually invest in their own property.

Local demand also factors in with many breaking tradition and opting to rent out. This is a widespread trend amongst the younger generation who prefer to rent out before purchasing their own property, as well as for single parents and separation scenarios.

But what kind of rental return is one to expect? At present this is estimated at between 3.5% to 6% per annum. It very much depends on the type of property in question, the location and more importantly the level of finishing and furniture. Many prefer to rent out properties that are in the proximity of their workplace with Sliema, Msida, St Julians, Gzira and the surroundings being most sought after. Special Designated Areas, such as Portomaso, Pendergardens, Tigne Point and Fort Cambridge are popular high end options, however smaller units in the region of €120,000 to €180,000 can still yield very attractive returns.

Proper finishings and modern furniture is a plus, with all common appliances and daily commodities being expected by the tenant. This does not need to scare off potential landlords as options are now available where one may furnish a complete rental property from just over €15,000.

WHY DO BUSINESS IN MALTA?
The business case in favour of Malta is clear. During these past 40 years, the country has notched up an impressive record in attracting foreign investors to Malta, and who continue to re-invest in their production and service facilities on the island. How has Malta achieved this? By successfully moving from labour-based to knowledge based industry and in so doing, attracting Foreign Direct Investment from countries like the UK, German, Italy, France, Spain and the United States. Malta’s favourable industrial climate and pro-business policies have been the pillars on which foreign companies have built their success.

Direct labour costs also hold up well, at a competitive 30% to 50% of those in the older EU Member States. However, when labour costs, productivity and working hours are factored together, the picture is even better. Malta’s workforce then becomes cheaper than many established EU economies. What’s more, when social security costs and other employment taxes are added in, Malta’s total labour costs are competitive with the new EU Member States and significantly lower than established EU Members.

The Maltese industrial relations law follows the British system of industrial relations. The shop steward represents the trade union at shop-floor level and collective bargaining is conducted at enterprise level. Strikes and stoppages are rare occurrences. The legal structure, accounting practices and trading environment run along UK lines as does the education systems.

There is also a strong national commitment to attracting foreign investment. In Malta there are no restrictions on foreign direct investment, so companies do not need to partner with a local company. TAXATION
The corporate tax rate payable in Malta stands at 35%. Malta has a single imputation system that avoids double taxation on companies and shareholders respectively. In fact, individual shareholders can receive a refund of up to 6/7th on any tax paid in Malta upon distribution of dividends. This makes the effective rate of tax in Malta 5%.

Moreover, tax liability can be further reduced through a mechanism of tax credits that Malta Enterprise grants to enterprises in selected sectors.

DOUBLE TAXATION AGREEMENTS
Malta has tax treaties with more than 65 countries which enhance the incentives provided by Maltese domestic legislation. Most of these treaties ensure such profits generated in Malta are either exempt from tax in the country of residence of the investor, or that such a country will provide a tax credit for the Malta tax spared as a consequence of the incentives Malta provides.

ROYALTY INCOME FROM PATENTS
The incentive gives fiscal benefits to persons (individuals and enterprises) that own the rights to patented intellectual property and are receiving income in the form of royalties.

The objective of this initiative is to encourage researchers to exploit intellectual property through the licensing of patented knowledge. The scheme should also encourage investment in research and knowledge creation and exploitation of intellectual property.

RESEARCH & DEVELOPMENT TAX CREDITS
Tax credits are available for enterprises investing in Industrial Research & Experimental Development. The tax credit percentage is related to the size of the enterprise. Additionally bonuses are provided to enterprise participating in collaborative projects with other industry partners or research organisations. Eligible costs include:

• Wages of researchers and technicians;
• Depreciation costs of instruments and equipment;
• Costs of material, supplies and similar products, bought specifically for the research project;
• Subcontracted research;
• Costs incurred for the purchase of technical knowledge and patents.

INVESTMENT AID TAX CREDITS
Investment Aid Tax Credits support enterprise in investment and job creation. The scheme is mainly focused on attracting new investment projects and promoting expansion or diversification of existing enterprises. This incentive is available to all sectors except specifically maritime, training and non-Maintenance Repair & Overhaul aviation services.

Eligible enterprises, as defined in the incentive guideline document, can benefit from tax credits calculated as a percentage of the value which is set according to the enterprise size. The principle beneficiaries are enterprises engaged in manufacturing, ICT development activities, call centres, pharmaceuticals, biotechnology, filming and audio-visual industries.

Tax credits are computed as a percentage of either the value of capital investment or the value of wages for 24 months covering new jobs created as a result of an investment project.

The tax credits which are not utilised during a particular year are carried forward to subsequent years.

LOCATION
The Republic of Malta consists of Malta, Gozo, Comino and two small uninhabited islands, and is situated in the middle of the Mediterranean Sea. Malta is 93km away from Sicily and 290km from North Africa.

PHYSICAL FEATURES
Malta has an area of 246 sq.km and is made up of a low plateau which descends gradually to the plain in the south-eastern part of the Island. Gozo, Malta’s sister island (67 sq.km), lies just 6.4km to the north-west. The longest distance across Malta is 27km, and the widest is 14km. The corresponding figures for Gozo are 14km and 7km respectively. Malta has no mountains – a series of terraced fields on hilly slopes characterizes the Islands. Malta’s coastline is well indented with natural harbours, sandy beaches and flat rock coves.

THE PEOPLE AND LANGUAGE
Throughout Malta’s long and chequered history, Malta’s people came into contact with the many nations that dominated the Mediterranean. These relationships with people of so many different cultures made the Maltese amongst the most cosmopolitan people in the world. The people of Malta have developed and maintained characteristics which distinguish them as a peace-loving nation with a strong sense of hospitality. Another characteristic is their joviality which springs mainly from the agreeable, warm climate with sunshine throughout the year. For the same reason, the Maltese enjoy very high standards of health. Today the Maltese population stands at 404,000. The national language is the Maltese language, however, both Maltese and English are official languages, and English is also spoken and understood by most. Malta became a full member of the European Union on 1st May 2004 and joined the Schengen zone in 2007.

TOURISM
Malta’s natural scenic wealth, its colourful culture and heritage, high standards of health, a most agreeable climate, political stability and the friendliness of its people have turned it into an all year round holiday destination. The tourist sector is one of the most important sectors of the Maltese economy with approximately 1,200,000 tourists visiting the islands every year. The British market represents 41% of this figure. CLIMATE
The climate is warm and healthy with mild, moist winters and dry, hot summers. Frost and snow are unknown. Rain falls only for very short periods, averaging 580mm in a whole year. Temperatures for November – April average 14°C , and 23°C for the May – October period. Average daily sunshine hours for winter are 6.5 hours, and for summer 10.5 hours. The hottest period is from mid-July to mid-September. Malta’s perennial sunshine and unpolluted sea make it a holiday destination to which tourists like to return year after year.

MEDICAL SERVICES
Medical services in Malta are very good and facilities are easily accessible, with a major general hospital (and a smaller one in Gozo) equipped with modern facilities. Specialists for the various disciplines in the hospital have obtained their higher post-graduate qualifications mainly from UK. There are also a number of peripheral health centres, which are open day and night. Private medical care is also available, and apart from general practitioner services, there are three private hospitals and a number of small private clinics where minor surgery can be carried out.

EU citizens, resident in Malta, are entitled to Free Public Health care services in accordance with entitlements, as determined from time to time by the Ministry of Health. Their entitlement has to be confirmed with and certified by the Entitlement Unit with the Ministry of Health. Applicant must be in possession of the appropriate E form signifying their entitlement to health care under the Social Security registration in their country of origin. This official certification, together with a personal identification document, will be sufficient to receive health care in public health care services.

Temporary visitors (under 1 year stay) from EU member states and EEA states have direct access to the health care from publicly funded health care services upon presentation of The European Health Insurance Card together with an identification document.

The Government of Malta is not responsible in any way for any treatment or care given to EU citizens in private hospital or health centres or by practitioners of any sort in their private capacity. COST OF LIVING
As compared to other countries, Malta is considered to be a country having one of the lowest costs of living in Europe. Foodstuffs, clothing and furniture are very reasonably priced. Services like water, electricity, telephone and gas are also very reasonable. No rates or council taxes are charged in Malta.

MAINTENANCE CHARGES
It is worth noting that the cost of labour in Malta is considerably lower than in the UK and many European countries, and this has a beneficial effect on foreign residents in such matters as maintenance of property, vehicles, domestic appliances, etc., Tradesmen such as carpenters, electricians and plumbers are competent and not expensive. Laundry and hairdressing bills are also reasonable. Maltese domestic staff are known for reliability and diligence.

PROXIMITY TO OTHER COUNTRIES (FLYING TIMES)
Malta – London 3.05hrs, Malta – Amsterdam 3.05hrs, Malta – Frankfurt 2.35hrs, Malta – Paris 2.35hrs, Malta – Rome 1.15hrs, Malta – Cairo 2.25hrs.

Sicily (Catania) is 3 to 6 hours sailing time from Malta depending on the type of craft used.

The national airline, Airmalta, operates regular flights to and from all major airports in Europe, North Africa, the Middle East and the Gulf States. Other international carriers including low cost carriers operate regular scheduled flights to and from Malta. There is a regular ferry service, which carries passengers and cars between Malta & Gozo, as well as a helicopter service from Malta International Airport. The ferry crossing takes about 30 minutes.

LOCAL TIME
Malta is on Western Europe time which puts the Islands one hour ahead of GMT. Between the last Sunday in March and the last Sunday in October the clock goes forward to local Summer Time by an additional hour (bringing us 2 hours ahead of GMT).

DRIVING AND LICENSES
All current licences and international driving licences are recognized. Driving is on the left. Speed limit is 40mph (65kph).

SCHOOLS
Malta has a free state school system with optional private education. Both day and boarding facilities exist and school fees are very reasonable. Lessons in private schools are taught in English, and the curriculum is very closely aligned to the British system with students sitting for Ordinary and Advanced level examinations to qualify for entrance into the Malta University and Universities overseas. Standards of education are high with English being the language of instruction for most subjects at all levels of the education system.

English is an official language and many Maltese are also fluent in Italian. Furthermore many take up French and German.

Malta can boast of having the oldest University in the Commonwealth outside Britain providing education for more than 10,000 students in all the major disciplines. The vocational and technical education systems offer courses in applied electronics, design, IT and others.

CHURCHES
Freedom of worship is guaranteed by the Constitution. Whilst the great majority of Maltese profess the Catholic Faith, other religious denominations have their place of worship in Malta. Although a Catholic country with Masses said in English as well as Maltese, there are also services available for most other denominations. The Anglican Cathedral of St Paul’s in Valletta and the Church of the Holy Trinity in Sliema have communion, matins and evensong on Sundays. The Union of the Church of Scotland and Methodist congregations meet at St Andrews (Scots) Church, South Street, Valletta and the Jewish Synagogue is at 9, Spur Street, Valletta.

SPORTS CLUBS
The principal sports club in Malta is the Marsa Sports Club, which is spread over a large area, offering facilities for tennis, an 18-hole golf-course, cricket, squash, swimming, general fitness and lots more. The Union Club in Sliema, on the other hand, is very much favoured by foreign residents for its pleasant club house and inexpensive restaurant. It has a bar, bridge room, barber and some excellent tennis and squash courts. In summer open-air dances are held on Saturdays. The clubs have an attractive beach concession at Tigne’, with a good restaurant, changing rooms, sea-water pools for children, deck-chairs and sun umbrellas.

RESIDENTS ASSOCIATION
There is a British Residents Association active in Malta and Gozo which organises many social and cultural events all year round. Any national is allowed membership.

DIVING
The Maltese Islands are a real paradise for divers and snorklers. Even in a severe winter (which is extremely rare) the sea temperature never drops below 13 Celcius. Sea temperatures in summer are about 23 Celcius, and divers may wear a light 3mm diving suit or even dive without one. The Islands offer a well-developed infrastructure for divers, representing a high standard and are capable of coping with the most sophisticated demands. There are a number of very well-trained staff at the many diving schools. It is not necessary to bring along your own equipment as it is possible to lease equipment at a very favourable rate.

The seas around Malta are virtually tideless, and due to the small size of our Islands, divers can shift to an alternative dive site very easily. Boat dives take the diver to sites which are not so easily accessible, and the variety of dive sites including wrecks, caves and others are abundant.

Spear fishing is absolutely forbidden as is removal and non-reporting of archaeological finds.

Anyone who wants to dive within the territory of the Maltese Islands needs a local diving permit, referred to as the C-card. It is issued by the Department of Health and costs 1 Maltese Lira. A medical certificate, 2 passport photographs and the logbook of the applicant must be presented. A diver wishing to dive independently of any dive school must present a certificate equivalent to at least the CMAS/2-Star diver certificate. All diving schools will ensure that the administrative procedures are compiled without problems, and even the very experienced would be well advised to apply through diving schools rather than on their own.

Due to the excellent underwater visibility and the variety of flora and fauna, there is no other diving destination within easy reach which offers such good conditions for underwater photography.

YACHTING
The Islands of Malta, Gozo and Comino provide an indented coastline of 200km with clear and clean waters, making a cruise around the islands a real delight. The sailing season stretches from April to November and even in the remaining winter months, sunny days are never far away. Yachts from all over the world can make use of yachting facilities at the excellent marinas at Msida, Ta’Xbiex, Mgarr (Gozo), and at the beautiful historic creek of Cottonera at very reasonable rates. Amenities include:- water, telephone, electricity, weather forecasts, DF Beacon, ship-to-shore radio, chart depot, supply of bottled gas, etc.

Malta is recognized as a suitable base for wintering one’s yacht. Maintenance during the mild winter months is not a problem. Excellent repair facilities exist and charges for hauling out and storing on hard are very reasonable. Several yachting agencies, which operate from the proximity of the yachting centers, undertake to look after yachts afloat over the winter and also carry out necessary maintenance work. A yacht yard comprising of 9 modern slipways is in full operation and has facilities for slipping, repairing, converting and servicing of yachts of all sizes up to 500 tons.

CABLE TV AND SATELLITE
Cable Television provides over 150 channels in different languages and includes BBC, CNN, NBC, Spanish TVE, French TV5, most Italian channels, a German channel and other movie and entertainment channels. Satellite dishes are also becoming increasingly popular, and can be bought and installed at a reasonable cost.

NIGHTLIFE, RESTAURANTS, LEISURE AND QUALITY CULTURAL EVENTS
The Islands have a vibrant calendar of theatre and concerts, classical and modern. Many are held outdoors or in historic venues. There are annual cultural events, such as the three-month summer Maltafest. Another regular is the International Jazz Festival in July. Now over ten years old, it’s seen legends and newcomers perform in a spectacular venue by floodlit Grand Harbour.

Malta is fast becoming the place for clubbing. Top international DJ’s appear for guest weekends throughout the year. Paceville and St. Julians are the centre of the scene. For excitement of a different kind, try your luck at the casino.

As a country providing locations for some Oscar winning films, Malta is naturally a film-loving society. The Islands have several state-of-the-art multiplex cinemas always with the latest releases.

Dining al fresco is one of life’s simple pleasures. Choose from romantic palazzo’s to bustling harbour restaurants and discover the range of Maltese cuisine, wine and beer. International cuisine is available everywhere. For a lively night out, nothing beats a summer fiesta. Saints, fireworks, food and fun are all part of this cultural phenomenon; one not to be missed.
